Gathering Documents

Most of my clients have expressed that the most difficult part of filing bankruptcy is gathering the documents necessary for disclosure and our preparation of the paperwork. Understand that I am required to disclose some of these documents and nearly all of them are used in the preparation of the bankruptcy documents filed with the Court.

Going into it, most clients fear the credit counseling, but then realize that it is a breeze consisting of a session of a little more than an hour of their time two different times, once just before their bankruptcy case is filed and again shortly afterward.

If you have lost your Social Security Card, please order a new one here on the Social Security Administration's website.  If you think you know where your card is, look to make sure. You must have it with you when you go to Court with me for your bankruptcy case.

Please don't fail to tell me about the paid-for boat in your back yard you just signed over to Uncle Bob. And if you're thinking about doing something like that, well, DON'T. If you're about to get a new high-paying job, marry a millionaire, or undergo what most folks would consider a major change, let me know.  The Bankruptcy Court will be looking for last-minute shady transactions to determine if you are fraudulently trying to protect non-exempt assets.  Most assets are exempt, and most people file bankruptcy and do not lose any property. Anyhow, last-minute transactions may or may not affect your bankruptcy case, but your failure to disclose them to me, your attorney, may very well doom your case and result in its dismissal and may negatively impact whoever else was involved in the transaction. Is there something you think I should know? Please disclose it.  The law, specifically, federal statute 11 U.S.C. § 527(a)(2) demands that the information and documentation you provide to the Court be complete, accurate and truthful. So answer questions honestly.
Below are downloadable documents for your convenience.  You will find our client interview form and agreement.  Also, you will find a checklist of documents we need to prepare your bankruptcy documents.  For example, we must review and get a copy of your auto, boat, or other titles, last 2 years' tax returns, last 3 months' bank statement, and last 6 month's pay stubs or statements for all adult persons who work within your household.  Finally, you will find an up-to-date list of approved credit counseling agencies from whom you can select an agency to use to fulfill the mandatory pre-bankruptcy credit counseling. For your benefit, we note which agencies offer the lowest prices for the counseling.
